ATLANTA, June 12, 2026 /Standard Newswire/ — The Election Night “secret bunker” hearing took place Wednesday in Fulton County Superior Court as SOS attorneys presented several bizarre legal arguments. The arguments attempted to justify Secretary of State (SOS) Brad Raffensperger’s secret aggregation of statewide election results that conflicts with Georgia law stating:
“Superintendents, poll officers, and other officials engaged in the conducting of primaries and elections held under this chapter shall perform their duties in public.” O.C.G.A. § 21-2-406
Candidates Greg Dolezal, Keli Gambrill and Chris Mora filed a writ of mandamus to force the SOS to comply with Georgia laws. They are seeking to have their representatives and State Election Board (SEB) members present at the bunker on Election Night where results are verified, aggregated and published. Dolezal, a current runoff candidate for Lieutenant Governor, and Mora both testified yesterday. State Election Director Blake Evans testified “vendors” were present in the bunker even though the SOS is preventing SEB members from observing. He added that bunker activities are “not required to remain confidential.”
SOS attorney Alexis Gregorian repeated the claim from her motion with Chris Anulewicz that: “The Secretary is not an official engaged in the conducting of primaries and elections.” [Pg 11] Gregorian did not explain how that could be true given that the Georgia SOS is the chief election official responsible for certifying all statewide results. She further contended that “Election Night reporting is not a duty of the Secretary” despite Georgia law which reads:
“Upon receiving the certified returns of any election from the various superintendents, the SOS shall immediately proceed to tabulate, compute and canvass the votes cast for all [federal and state] candidates… and shall thereupon certify…” O.C.G.A. § 21-2-499
Gregorian, a partner at Bradley Arant Boult Cummings LLP, attached to her motion a letter that Senior Assistant Attorney General Elizabeth Young wrote to SEB Chair John Fervier. It claims: “Superintendents and other local officials conduct primaries and elections, not the Secretary.”, “O.C.G.A. § 21-2-406 therefore does not require the Secretary to conduct his election night reporting activities in public.” [Ex: B] VoterGA co-founder Garland Favorito called on Young to resign at the last SEB meeting for issuing false legal advice. The Georgia Emergency Management Agency operates the bunker in metro Atlanta for state emergencies. No Georgia counties aggregate precinct election results in secret. A decision from Judge Melynee Leftridge is expected today. David Oles, who represents the candidates, summarized their claim: “All we are asking for is what the law says.”
