Robocalls, or artificial intelligence calls (AIC), are phone calls made by automated dialing devices. AIC technology is often utilized by federal office holders, candidates, and issue advocacy groups as a cost effective and efficient method of communicating to their constituents and supporters. Bills are being considered in both the United States Congress and several state legislatures to place restrictions on the political uses of AIC technology.
Bopp warned the Committee that intrusions upon this area of political speech violate the First Amendment. "Using AIC technology is no different than door-to-door solicitation – it is protected political speech at the heart of the First Amendment," stated Bopp. "Furthermore, prohibiting AIC technology would foreclose a primary method of communication for many non-incumbent candidates and non-profit issue advocacy groups."
Bopp also noted that advancements in AIC technology assure that its use poses no threat to residential privacy: "Just like a live operator, AIC technology can automatically terminate a call if the recipient does not consent to hear the message."
